Spouse or De Facto Visas
Are you in a relationship with an Australian citizen or permanent resident and want to stay permanently in Australia. Whether you are married or living in a de facto relationship. We can assist you to get your partners permanent visa. Since 1 July 2009 same-sex couples apply under the same visa class as de facto couples.
Spousal visa's are a 2 phase visa. Firstly a 2 year temporary visa is issued which will become a permanent visa if the relationship is still together at that time. This is to prevent spousal fraud. In some instances it is possible to be granted the permanent visa immediately, such as when the couple have children or have been married for over 5 years.
- You must be old enough to marry.
- Marriages NOT recognized include:
- Arranged or proxy marriages (husband and wife must have physically met before marriage, and live together after marriage);
- Polygamous marriage;
- Marriages within prohibited degrees of relationship (generally meaning close family members);
- Marriage of convenience;
- Marriage that is only recognized by custom.
- If unmarried – must be in a de facto or same-sex relationship:
- Live together (or do not live apart on a permanent basis);
- Commitment to a shared life as husband and wife to exclusion of all others;
- Must have lived together for a period of at least 12 months prior to lodging visa application.
This visa can be applied for onshore or offshore.
