Student Pathways to Permanent Residence - 485 / 885 visas
The student pathway has been severely restricted due to changes in the Migration Act and Regulations. You will fall into one of 3 circumstances
Hold a Student Visa (subclass 572, 573 or 574) on 8 February 2010.
You can apply for a 485 (TR) visa if your occupation is on the old Standard Occupations List but you will only be allowed to apply for the 885 (PR) visa if your occupation is on the new Standard Occupations List.
Applied for (bridging visa) or hold a 485 (TR) visa on 8 February 2010.
You can apply for an 885 (PR) visa if your occupation is on the old Standard Occupations List (or the new Standard Occupations List if that is better for you)
I can not apply for the 885 - GET A JOB !!!!.
If you are currently doing a course that isn't going to lead you to Permanent Residence, such as Hair Dressing or Cooking, then you're pathway is now on the Employment paths... Once you are qualified (which for trades is after 1 year) get yourself a skills assessment and an IELTS test above 5.0 (all 4 tests) and GET WORK with an employer who will pay you above $47,480 and look at the 457 options. If you cant earn that much as a graduate, then get out to a regional area and find work there and look for an employer who will sponsor you on the RSMS scheme.
ENS/RSMS for Graduates (ANZSCO 1-2 Occupations)
Recent (and unannounced) changes to the Employer Nomination Scheme provide for graduates with occupations in ANZSCO 1-2 (IT and Accounting for example) to obtain an exemption from the 3 year work experience requirement, if they satisfy the 2 year study requirement and apply within 6 months of graduating.
2 Years Study
If your occupation is no longer on the Standard Occupation List... The 2 year study rule is a COMPLETE waste of your money if you are in ANZSCO 3-4 occupations (most trades). Once you'd completed your Cert III then you can forget about that Diploma in Hospitality or Business Management, you were only doing that to satisfy the the 2 Year Study requirement. Save the cash and start working in your field. That is your new pathway !
Overseas Students who satisfy the 2 year study requirement are able to apply for on shore permanent residence, provided they apply within 6 months of satisfying the requirement and have applied for a Skills Assessment. For students who are studying trades, you will need to complete the Job Ready Program, this takes 12 months and so Trades students will need to apply for the 485 Temporary Residence visa prior to making an application for permanent residence.
The 2 year study requirement requires you to complete 92 weeks of study according to the CRICOS register at Australian institutions. The study must lead to a Diploma, Degree or Trade Qualification. If you do more than 1 course, the courses MUST be related. The study must occur over at least 16 calendar months.
Some students must however complete a professional year on a further temporary visa before they can get registered or licensed in their profession in Australia. This could also be the case if you lack sufficient points to pass the points test and need more time to study English, complete a professional year etc.

It is a requirement that you have completed an IELTS exam prior to applying and the wait list for exams in Australia is particularly long. You should be booking an IELTS exam prior to completing your course.
