Migration Review Tribunal and Appeals.

Many applicants, particularly applicants who have applied directly without the services of a Registered Migration Agent, find that their initial application has been rejected. For onshore applicants and those applicants offshore with an Australian sponsor. There is a review process through the Migration Review Tribunal commonly referred to as the MRT.

 

MRT review is essentially a "second chance" to apply and is treated as a fresh application. This allows you to put on further evidence in support of your application if it was lacking or missing in the initial application.

 

MRT review can NOT be successful if you did not meet a Time of Application criteria such as IELTS results or Work Experience requirements for a PR Application.

 

MRT Application Fees are $1400 and as this is often cheaper than making a fresh application, it is worthwhile considering review options prior to re-applying. MRT Fees are refunded if your case is successful.

 

MRT Reviews are held in an informal court setting, there is a Member who asks questions and the Applicant. This is not a typical adversarial court system with a prosecution and defense. Registered Migration Agents are allowed to represent and prepare a case for Applicants and most Members allow the Agents to make the submissions to the MRT.
