Ministerial Intervention

Ministerial Intervention is a a last-effort fail safe mechanism that is built into the Migration Act that allows visa applicants to appeal their case directly to the Minister for Immigration.

 

Applicants can only apply for Ministerial Intervention once they have received a rejection from the Migration Review Tribunal or the Courts.

 

Ministerial applications are dealt with the Minister for Immigration personally and there are approximately 5000 cases queued up waiting to be assessed. The chances of a ministerial intervention application succeeding is less than 5% statistically however a large number of people make poor applications merely in order to stay in the country for a further year during processing so this figure is not representative.

 

Ministerial applications are highly technical and require large amounts of effort both on the part of the Migration Agent and the Visa Applicant to provide valid reasons why Ministerial Intervention should be granted.
